Damage Protection & Liability Disclaimer

ToolShare does not currently partner with an insurance provider, but we are actively working on offering an optional insurance policy for additional protection in the future.

As we establish our marketplace, we ask all participants to only list tools they feel comfortable renting under our current Damage Protection terms. If a tool’s value exceeds the waiver coverage or requires additional protection, owners should take that into consideration before listing.

For a limited time, every ToolShare rental automatically includes a Loss Damage Waiver (Damage Only) at no extra cost. This waiver provides up to $200 in coverage for accidental damage, helping to reduce financial risk for both renters and owners.

IMPORTANT NOTICE: ToolShare is not an insurance provider, broker, or agent, and the Loss Damage Waiver is not an insurance policy. It is a limited protection waiver designed to temporarily reduce financial risk for tool owners while we build the platform. This waiver should not be confused with traditional insurance, and it does not provide comprehensive coverage for all potential losses or damages. We are actively working on offering an optional insurance policy for additional protection in the future.

What’s Covered?

  • Accidental or unintentional damage that occurs during the rental period.
  • Damage sustained while the tool is in the renter’s possession.

What’s Not Covered?

  • The waiver does not cover intentional misuse, negligence, environmental damage, theft, or loss. Renters remain fully responsible for any excluded damage, as well as peripheral items like batteries and cables.

How Does It Work?

  1. Photo & Video Documentation: Renters and owners must document the tool’s condition at pickup and return.
  2. Immediate Reporting: Any damage must be reported to ToolShare with supporting evidence.
  3. Review & Resolution: ToolShare will assess the claim and determine coverage.
  4. Payment Responsibility: If exclusions apply, the renter is responsible for full repair or replacement.

While we are actively working on additional optional insurance coverage, this Loss Damage Waiver helps provide basic protection and peace of mind for ToolShare users.

Assumption of Risk

By renting a tool through ToolShare, you acknowledge that using power tools, woodworking tools, metalworking equipment, construction tools, and other heavy machinery carries inherent risks, including but not limited to:

  • Physical injuries such as cuts, burns, fractures, amputations, electrocution, and permanent paralysis.
  • Property damage due to improper handling, malfunction, or tool failure.
  • Health risks from exposure to hazardous materials, dust inhalation, toxic fumes, excessive noise, or repetitive motion injuries.
  • Severe injuries or death from kickback, binding, electrical hazards, flying debris, or lack of proper safety measures.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU KNOWINGLY, VOLUNTARILY, AND FREELY ASSUME ALL RISKS, BOTH KNOWN AND UNKNOWN, OF RENTING OR USING A LISTING FROM TOOLSHARE. This includes risks arising from:

  • The negligence or carelessness of the Owner, ToolShare, or third parties.
  • Defects in the equipment rented.
  • Unsafe conditions at any location where the Listing is used.
  • Improper handling, maintenance, or operation of the Listing by you or others.

By renting through ToolShare, you accept full responsibility for any consequences arising from the use of a tool, including personal injury, property damage, or financial loss. ToolShare does not own, inspect, or maintain Listings and is not responsible for their safety, functionality, or condition. All responsibility for proper maintenance and safe operation rests with the Owner and the Renter.
